YES - A SETTLEMENT HAS BEEN REACHED!!

We are pleased to inform you that your overtime case against Allstate has SETTLED. Under the terms of the settlement, Allstate is obligated to pay up to $120 million to resolve this matter.

Over the last 5 years, we have been actively litigating this case.  Approximately 385 adjusters and 25 supervisors were deposed in preparation for trial.  Tens of thousands of Allstate documents were produced, reviewed, and analyzed.  We had numerous meetings with key adjusters who we would like to thank for their cooperation and assistance as we prepared to go to trial.

We were at the courthouse steps, ready to go to trial when Allstate initiated settlement negotiations.  The trial date was continued in order to allow the settlement discussions to continue, which enabled us to agree upon a broad outline of a settlement.  We retained the services of a retired California Supreme Court justice to act as mediator in assisting us with working out the details in order to finalize a settlement agreement.  (As you can imagine, a settlement of this magnitude is extremely complex.)

Under California Class Action rules, we will now go through the process of obtaining approval of the settlement from the Court.  The first step has already been achieved.  On September 13, 2005, Judge Anthony Mohr of the Los Angeles Superior Court preliminarily approved the settlement.  He authorized us to mail notice of the settlement to all Class Members. Notice will be mailed out on September 23, 2005.  If you are a class member and have not received your Settlement Notice and Claim Form by October 7, 2005, please contact us at 888-587-7100.  In the alternative, you may download a claim form from this site and mail it to the Claims Administrator.  Please read the Settlement Notice carefully to make sure that you are included in the settling class.

The second step in the approval process is the Fairness Hearing.  That hearing will be held on October 31, 2005 before our court appointed Referee, who will make a recommendation to Judge Mohr concerning the settlement.  We anticipate that Judge Mohr will grant final approval at that time.

All of your rights are fully described in the Notice of Class Action Settlement that is being mailed to you.  The Notice also provides you with specific deadlines that are important.  Please read it carefully.  This posting on our website is not meant to take the place of the Notice.

While this approval process is proceeding, Class Members should send in their Claim Forms to the Claims Administrator.  Once those are all received and other administrative matters are addressed, settlement checks will be mailed to Class Members who filed timely claims.  It is too early to attempt to project a date that the checks will be mailed, please be patient.  We will continue to update the website as we know more information.
